These terms and conditions (the "Conditions") of www.homefinity.de (herein ,seller'), apply to all contracts which a consumer or entrepreneur (herein ,customer') with the seller in terms of the seller in its online store goods and / or services shown completes. This is the involvement of its own conditions of the customer are objected to, unless it is otherwise agreed.

3. Offer and Conclusion
The presentation of products in the online shop is not a legally binding offer, but an invitation to order. Errors are reserved to us. By clicking the button, Buy' enter a binding order for the products listed. Before submitting the order, the customer can view the data at any time and change. This order, however, can only be submitted and transmitted if the customer the click the button ‘Accept Conditions’ and thus accepts these conditions and thereby gives his order.
The seller then sends the customer an acknowledgment of receipt of the order by email in which the order of customer is listed again. This automatic acknowledgment of receipt only documents the receipt of the order and does not constitute acceptance of the contract. 4. Delivery and Availability
If the products are not available at the date of order of customer, the seller will inform the customer immediately. If a product is permanently out of stock, the seller will not accept the order. The contract will be concluded in this case.
If the product specified by the customer in the order is temporarily not available, the seller informs the customer immediately, too. In a delivery delay of more than 14 days the customer has the right to withdraw from the contract. This is, moreover, in this case also the right of the seller. In this case possibly already made payments will be immediately refund.
Consumers have a fourteen-day withdrawal. You have the right to withdraw within fourteen days without giving a reason from the contract. The withdrawal period is fourteen days from the date on which you or a representative third party other than the carrier have taken possession of the final goods.
To exercise your right, you must contact us in writing (Homefinty GmbH, Robert-Perthel-Straße 3, 50739 Köln, Germany) or by phone at Tel .: +49 (0) 221 95,264,061 by way of unambiguous declaration (e.g. with sent by post mail or e-mail)inform of your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient that you send your communication concerning the right of withdrawal before the withdrawal period.
If you withdraw from this contract, we will reimburse all payments we receive from you, only the costs of supply, and with the exception of the additional costs arising from the fact that a type of delivery other than that offered by us, cheapest Standard delivery have been chosen, and repay immediately latest within fourteen days from the date on which the notification has been received about your cancellation of this contract with us. For this redemption we use, wherever possible, the same form of payment that you used in the original transaction, unless you explicitly agreed otherwise; in any case you will be not charged fees for this repayment. We may withhold reimbursement until we have received the returned goods back, or until you have demonstrated that you have returned the goods, whichever is the earlier. The deadline is met if you send the goods before the period of fourteen days. The, customer 'bears the direct cost of returning the goods.
You only need to pay for any diminished value of the goods, where the value loss is due to a necessary to ascertain the nature, characteristics and functioning of the goods dealing with you.

6. Price and shipping
Described on the product pages include VAT and other price components for deliveries within Germany. Binding Prices are the prices at the time of order. Prices for all other countries are net prices. Duties or similar charges are respective to the customer. Delivery Countries are in Europe. For an overview of all possible shipping costs (here)
The estimate of the shipping costs to the customer are specified in the order form and are paid by the customer, so far as it does not exercise his right of withdrawal.
The customer has to bear the costs of returning in the event of cancellation.
The order will be shipped with selected service providers. The shipping risk is at our side when the customer is a consumer.
If the shipping company sent the goods back to the seller due to the purpose the customer could not be reached, the customer has to bear the cost of unsuccessful delivery. This does not apply if he is not responsible for the circumstance which has led to the impossibility of delivery or if he was temporarily prevented from accepting the service offered, unless that, the seller has announced the delivery in reasonable time in advance.

Payment via Paypal +. For credit card payment or Sofortuberweisung no mandatory registration of customers' Paypal is required.
The payment methods offered include payment by credit card (Visa, MasterCard), bank transfer or payment via a Paypal account.
The payment of the purchase price is due immediately after the conclusion of the contract.
9. Redemption of vouchers
Vouchers issued under of promotions with a specific validity period and cannot been bought from customer, in following called ‘Promotional codes’, can only be purchased in the online shop of the seller and redeemed in the specified period.
Individual products may be excluded from the coupon action, provided that such restriction on the content of the promotional code results.
Promotional codes can only be redeemed prior to the conclusion of the ordering process. An allocation afterwards is not possible.
Per order only one promotional code can always be redeemed.
The value of goods shall be at least the amount of the promotional code match. Eventual remaining balance will not be reimbursed by the seller.
If there is insufficient value of the promotional code to cover the order, one of the other payment methods offered by the seller can be chosen to pay the difference.
The credit of a promotional code will neither be paid back cash nor credited with interest rate.
The promotional code will not be refunded if the customer returns the action with the coupon completely or partially paid goods under its statutory right of withdrawal.
10. Costs of returning
In case of a return, the customer has to pay the return costs if the delivered goods ordered corresponds and if the price of the order or product does not exceed an amount of EUR 40 or if the customer in case of a higher amount at the time revocation has not yet paid the consideration or a contractually agreed partial payment.
11. Retention of title
Until full payments are done the goods remain our property.
12. Transport damage

The failure of a complaint or contact has no consequences for your statutory warranty rights, but help us to make our own claims against the carrier or the transport insurance.

14. Final provisions
The law of the Federal Republic of Germany shall apply to all legal relationships and agreements between the parties.
If any provision of these terms and conditions be invalid, the contract will remain valid. Instead of the invalid provision, the statutory provisions are valid.
The jurisdiction is Cologne, Germany.
Legally binding is the German version of the general terms and conditions.
